Device Select LLC dba HEALTHPOYNT® (hereinafer HealthPoynt®) maintains the HEALTHPOYNT® company web site (hereinafter the Site) which incorporates this Privacy Policy into its Terms of Service which precede these policies and are available on the Site. By agreeing to those Terms and Conditions, you hereby agree to the following terms of this Privacy Policy. You also consent for HEALTHPOYNT® to use and disclose certain information, which may include some personal identifying information, as set forth in this policy. 1. Personal or Medical Information

  • In order for HEALTHPOYNT® to appropriately provide a service as a healthcare advocate, you may have to provide a certain level of personal and medical information, and/or HEALTHPOYNT® may obtain such information from other sources. This information will not be disclosed or sold to third parties with the exception of what is provided in this Privacy Policy.
  • Should you desire additional materials about HEALTHPOYNT® and its services, you will be required to provide HEALTHPOYNT® with some contact information. In some instances, although it is optional, you may be asked to provide information such as your employer, healthcare plan, and/or the plan’s third party administrator (hereinafter TPA). Such information will enable HEALTHPOYNT® to deliver the additional materials.
  • In some instances your employer, healthcare plan or TPA may have preliminarily provided us with some information about you to enable us to set up your account. Prior to completion of the registration process, you will be asked to agree with our Terms and Conditions. At any time, you may elect not to receive information from HEALTHPOYNT®.
  • During HEALTHPOYNT®’s registration process you, your employer, healthcare plan and/or TPA will be required to provide specific contact information for you and your dependents such as your names, addresses, dates of birth and telephone numbers. During registration, you may be asked to provide some additional information such as the names, addresses, telephone numbers and ID numbers of the your employer, health plan, and/or TPA. This registration information may either be provided by you directly or indirectly through your employer, health plan, and/or TPA. Whether this information is provided directly or indirectly, you hereby consent to this Privacy Policy and its preceding Terms and Conditions.
  • You may have already been referred to HEALTHPOYNT® through your employer, heath plan and/or a TPA. In this case, you have been pre-registered with HEALTHPOYNT®, and thus, assigned a user name and temporary password. You may be required to set up a more permanent user name and password prior to registration or simply to receive materials from HEALTHPOYNT®. At some point prior to providing certain information, you will be asked to agree to HEALTHPOYNT®’s Terms of Service.
  • As a healthcare advocate, HEALTHPOYNT® provides its clients with information such as treatment options, and, in some instances, associated costs and expenses. In order to provide these services, HEALTHPOYNT® will obtain, record and maintain its clients’ personal and private information which is obtained through the clients, their employers, healthcare plans and/or TPAs. This information will not be used or disclosed by HEALTHPOYNT® unless such use or disclosure is authorized through the provisions contained in this Privacy Policy, or with your consent, or where it is required by law. This information may be provided to HEALTHPOYNT® through certain data channels or systems. This may require you to provide the your employer, health care plan and/or TPA with the requisite consents. You may also be required to provide information such as a user name and password to access these channels or systems. Should you, your employer, healthcare plan or TPA select this option, HEALTHPOYNT® is hereby authorized to access such data channels or systems and obtain and use the information in accordance with this Privacy Policy.
  • In some instances, you will provide HEALTHPOYNT® with financial or healthcare payment information which may be personal or regarding your healthcare plan and/or TPA.
  • In addition to the information provided by you or on your behalf, HealthPoynt® automatically obtains and records other information from your computer. This information includes IP addresses, cookies, other software/hardware attributes of the computer you use.

2. Information Use 
The information HEALTHPOYNT® collects from you, your employer, healthcare plan, and/or TPA is stored and used to provide you with information and other healthcare related services. This information may be used as follows:

  • To provide you with access to all information that has been provided to HEALTHPOYNT® on your behalf.
  • To provide you with specific healthcare claims information whether or not you are seeking insurance benefits.
  • To improve HEALTHPOYNT®’s services and your user experience.
  • To comply with requirements under the law.
  • To communicate customer service issues and service updates to you.
  • To provide you with your own tailored HealthPoynt® experience.
  • To enforce the HEALTHPOYNT®  Terms of Service.

3. Information Sharing 
Some user information may be shared or disclosed by HEALTHPOYNT® as follows:

  • To comply with requirements under the law or in accordance with the provisions of this Privacy Policy, or otherwise under circumstances by which you have consented.
  • To provide you with HEALTHPOYNT® services. In some instances, it is necessary for HEALTHPOYNT® to share information with third parties who work with HEALTHPOYNT® to provide you with services. These third parties will be required by HEALTHPOYNT® to support the provisions of this Privacy Policy, and thus, only use your personal information to provide you with these services.
  • Please note, you will have the capabilities to hyperlink to thirdd party web sites through the Site. These third party web sites may request you to provide them with personal information. Please note, the provisions of this Privacy Policy do not apply to these third party web sites.
  • From time to time, HEALTHPOYNT® may share or use certain information or data related to you for secondary data analytics tasks. In these instances, sharing or use of such information requires HEALTHPOYNT® to de-identify your information, thus your identity will remain anonymous.
  • This de-identified information may be sold to or used by third parties.

4. Storage and Maintenance of Information 
In the event you decide to have some or all of your personal information removed from HealthPoynt®’s data base, simply contact your healthcare plan, TPA or HEALTHPOYNT®.

5. Security 
The Site is secured through the use of GoDaddy SSL Certificates to encrypt data which is passed between you and the HEALTHPOYNT® server. All servers are protected by a Cisco ASA firewall, and all passwords are encrypted using the PBKDF2 algorithm.

6. Cookies 
The Site uses cookies. By accessing the Site you consent to the use of cookies in accordance with this Privacy Policy. 

A cookie is a small file which asks permission to be placed on your computer’s hard drive. Once you agree, the file is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences. 

HEALTHPOYNT® uses a cookie to recognize your computer when you visit the Site, in order to populate the login box and record whether you are logged into the Site. This is only done if you have explicitly registered with HEALTHPOYNT® . 

A cookie in no way gives HEALTHPOYNT® access to your computer or any information about you. In order to prevent unauthorized access or disclosure, HEALTHPOYNT® has put in place suitable security measures to safeguard and secure the information collected online. We are committed to ensuring that your information is secure. 

You can choose to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if prefered. Most browsers allow for the rejection of cookies. However, if you decline cookies, you may be prevented from taking full advantage of the Site. 

When and if you chose to click on the hyperlink of HealthPoynt® sponsors and/or partners, you will be subject to these third parties’ cookie use policy. HEALTHPOYNT® has no control over these third parties’ use of cookies or the information collected through cookies.

7. User Obligations

  • You should never share user names and passwords. You should always log out when you are finished using HEALTHPOYNT®'s services via the Site.
  • HEALTHPOYNT® will make additions, deletions or edits to this Privacy Policy, in the event changes are made. Thus, HEALTHPOYNT® advises that you check here for any changes to this Privacy Policy.
  • You will be notified via email if there are changes in how HEALTHPOYNT® uses and discloses your personal health information. You will then be given an opportunity to disallow HEALTHPOYNT® from using or disclosing personal health information provided by you (or on your behalf) prior to the change in the Privacy Policy.
  • You should direct any questions regarding this Privacy Policy or HEALTHPOYNT®’s use of information to your health plan, TPA or HEALTHPOYNT®.
